For immediate release: LPL asks for judicial review of City’s rejection of pro-life ads
On January 14, 2019, Lethbridge and District Pro-Life Association (“LPLâ€) commenced a claim for judicial review of a recent decision by the City of Lethbridge to reject all five of LPL’s innocuous advertisements. The five ads included an ad which featured a healthy newborn baby with the caption, “Life Should be the Most Fundamental Human Rightâ€. Another featured a picture of a pregnant woman with the caption, “Equality Should Begin in the Wombâ€.
In its reasons for the rejection of the ads, the City cited the removal of a previous LPL ad. The City stated that because LPL’s prior posted “Preborn Babies Feel Pain†ad had been removed in spring of 2018 due to “adverse community reactionâ€, LPL should not be allowed to share its message further because of a “heightened awareness to the LPL brandâ€. Therefore, any ads which LPL applies to post in future would not be permitted by the City.
The recent decision of the City comes on the heels of LPL attempting to post its “Preborn Babies Feel Pain†ad for over two years. In April 2018, “Preborn Babies Feel Pain†was removed shortly after the City had finally agreed to post it. The City justified this decision by saying that it had received over 100 emails as well as other “complaints", with the “large majority†opposing the ad. These complaints came from individuals working in coordination with two pro-choice lobbyist organizations.
At the same time, two petitions were initiated to support LPL’s right to free speech. These two petitions garnered over 1900 and 1200 signatures. The City refused to listen to these over 3000 signatories, and instead pulled the ad on the basis of approximately 100 pro-choice lobbyists.
“This expression is about as innocuous as it getsâ€, says Carol Crosson, the constitutional lawyer representing LPL. “The City has made it clear that if you don’t hold the same opinion as the City, you will not be treated equally. The Charter requires that the City respect the right to freedom of expression, and act in an unbiased fashion. Yet the City refuses to allow any of LPL’s pro-life speech and has acceded to the whims of 100 pro-choice lobbyists rather than over 3000 of its own residentsâ€.

“No government entity should be able to ban speech on one side of any issueâ€, commented LPL’s spokesperson. “However, the City has done just that. If you do not hold the opinions the City favours, it does not matter how many support you. You will not have a voiceâ€.
